Terms & Conditions
1. Our Products
1.1 Products are subject to availability. If we are unable to supply your chosen item we reserve the right to substitute a product of equivalent value, quality, and color and we will notify you within 24 hours via email.
1.2 If we are unable to provide your chosen item or a suitable substitution we will advise you within 48 hours via email and refund your payment in full within 7 days. The transaction fee is charged by a third party (wix.com) of 5% which is not refundable.
1.3 Wedding packages are priced for best seasonal availability, we will select the flowers for the package, taking into account bridal style & colors.
2.1 Prices listed are valid for a maximum of 7 days after placing your order. If you see a price drop after placing your order within 7 days, we will refund the difference to your original payment method.
2.2 Prices are the pre-tax price that excludes VAT or delivery charges. The current sales tax rate is 9.5%.
3. Orders / Payment
3.1 In order to fulfill your order we require all necessary fields contained within the order form to be completed with the relevant information. By submitting your order and payment details, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the site.
3.3. Payment Security We recommend you order online using our secure order form or by phone.
3.4 Your purchase will be deemed to have occurred in Los Angeles, California. These Terms and Conditions shall be governed by and construed in accordance with Los Angeles Law and the parties agree to submit to the exclusive jurisdiction of the Los Angeles courts.
4.1 Delivery charges will be applicable within the specified area.
4.2 Should a timed delivery be requested we will endeavor to comply with the request via email before placing your order but cannot be bound in any way to honor such a request during some specific date.
4.3 Where incorrect personal and delivery details have been supplied problems or delays in delivery may result, therefore please ensure that you have included the full address details of the intended recipient and your daytime telephone number or e-mail address so that we can notify you in the event that any delivery problems occur.
4.4 Whilst we will make every effort to ensure that delivery is made on the requested date you acknowledge that in very rare circumstances delivery on the requested terms will not be possible. In this event, you will be given prior notice wherever possible and we shall either make alternative arrangements or shall refund your payment in full.
4.5 Where a third party is involved during delivery, such as hospitals, schools, offices, the signature of any person authorized to accept delivery on behalf of the organization shall be accepted as proof of delivery to your chosen recipient.
4.6 In the instance of there being difficulties in delivering your order to the intended recipient we reserve the right to contact the recipient using the contact details you provide on the Order Form. Should the recipient not be home we will attempt to deliver to the front desk of the office building, leasing office, or an authorized recipient. If we fail to deliver to the recipient, we will notify you via email or phone call to figure out the best solution.
4.7 If we fail to deliver and fail to contact the recipient or purchaser after 48 hours of the delivery date, we cannot offer any type of refund. Redelivery or pick-up is available within 48 hours of the delivery date.
5.1 Orders may be amended or canceled up to 72 hours before the intended delivery date. The transaction fee is charged by a third party (wix.com) of 5% which is not refundable.
6.1We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Online Site and/or the Online Service from time to time. We will post any changes on the Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Online Service or Online Site. Changes will be effective right after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
6.2Additionally, we reserve the right to suspend, restrict or terminate access to the Online Site and/or the Online Services for any reason at any time.
6.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers, and other terms contained in the Online Site, provided that in the event of a conflict between any such other notices, policies, disclaimers, and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
6.5 A person who is not a party to the agreement between you and us has no rights to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists under the law.
6.6 Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
Privacy & Safety
If you do not agree to the terms of this Policy you may not use our website.
We may amend, add to, change, or modify the terms and conditions of this Policy from time to time. Such amendments will be posted at the URL and take effect when posted. By continuing to use our website, shopping this website, or registering for an account with Avas Flowers, you agree to the terms of this Policy and any amendments thereto. You further agree to use your "Personally Identifiable Information" by us in the manner specified in this Policy.
We will never share your personal information with anyone except as described in this Policy.
1. Information Collected
We collect two general types of information, "Non-Personally Identifiable Information" and "Personally Identifiable Information." We collect this information generally to process orders and to improve our website.
a. Non-Personally Identifiable Information
When you visit our website, we may collect some basic Non-Personally Identifiable Information or NPII about you. We collect non-personally identifiable information about you in several ways, including tracking your activities through your IP address, computer settings, or most recently visited URL. We may also ask you to provide certain non-personally identifiable information about yourself, such as your age, household income, buying preferences, etc.
Non-Personally Identifiable Information is collected to provide you with satisfactory service and to improve our website. We may use the information to detect problems with our server and to administer our site. In addition, Non-Personally Identifiable Information is compiled by us and analyzed on an aggregate basis.
3rd party services we share NPII with:
Google - Your NPII may be shared with Google Analytics and Google Ads. We share information with Google for marketing purposes and to gauge the effectiveness of our ad campaigns. We also share information with Google to provide metrics on the customer experience on our site to constantly understand how we can better the experience for our visitors. This data is shared with but not sold to Google.
Bing Universal Event tracking - NPII pertaining to your activity on the site may be shared with Bing Universal Event tracking. This information is shared with Bing in order to get metrics on the customer experience on our site in an effort to understand how to better improve our site. This data is shared with but not sold to Bing.
C Blanc Rose uses Wix surveys to collect feedback from customers on their online ordering experience to help us continually improve on this. NPII is shared with Wix.com. However, PII or personally identifiable information is directly provided by the customer should they choose to complete the survey.
b. Personally Identifiable Information
We do not collect any Personally Identifiable Information or PIII about you unless you voluntarily submit such information to us, by, for example, registering for an account or placing an order for flowers or other products. This information lets us know the specifics of who you are and can be used to identify, contact or locate you.
Personally, Identifiable Information may consist of: your name, address, telephone number, email address, birth date, billing information (credit card number, expiration date, and billing address), occasion type (Valentine's Day, etc.), products purchased, any relevant promotion code and information (for example, reward program account information) and the gift and message recipient's name, address, telephone number, email address and any other information you may provide us ("Personally Identifiable Information"). By providing us with Personally Identifiable Information, you consent to our use of that information.
We use Personally Identifiable Information for internal purposes, such as confirming and tracking your order, subscription, or registration, analyzing trends and statistics, and informing you of our new products, services, and offers.
Personally, Identifiable Information is compiled by us and analyzed on both a personal and an aggregated basis.
To serve you better, we may combine Personally Identifiable Information you give us online or through our catalogs. We may also combine that information with publicly available information about you that we may receive from third parties.
We use that combined information to enhance and personalize your shopping experience with us, to communicate with you about our products, and for other promotional purposes.
We may contract with third-party companies or persons to provide certain services including credit card processing, local delivery, distribution, data management, promotional services, etc. ("Service Providers").
We provide our Service Providers with the information needed for them to perform these services. We also ask our Service Providers to confirm that their privacy practices are consistent with ours.
c. Your Privacy Rights
You may request a report on personally identifiable information about you we may have stored based on your order history. Please note Personal Identifiable Information stored based on orders placed with C BlancRose is not shared with or sold to any 3rd party. Please send all requests to firstname.lastname@example.org. Be sure to include your full name and email address used for any orders you may have placed with C Blanc Rose.
You may opt-out of receiving marketing emails from C Blanc Rose. If you have an account on cblancrose.com, you can log into your account and change your email opt-in status. If you do not have an account, you can call us at 626-698-8504 to have your email address removed from our mailing address.
If you have an account set up on our site, you may have contacts set up in your account address book which you may no longer wish to be stored on our servers. Please review your address book and delete any contacts you no longer want to be stored. Please note address book data is not shared or sold with any 3rd party.
You can opt-out of Non-Personally Identifiable Information being shared with select 3rd parties. Please note this information is only shared with 3rd parties and not sold. Please also note that you can not opt-out of Non-Personally Identifiable Information from being shared with 3rd parties for "Business purposes" as defined by the California Consumer Protection Act 1798.140
2. Registering For a Personal Account
When you register for a Personal Account on our website, you provide us with Personally Identifiable Information. This information allows us to identify you and also allows us to prepopulate information fields when you place an order.
Your Personal Account is password protected from third parties. You may access your Personal Account by requesting your password from us (go to My Account) and then signing in with that password.
Afterward, you may change your password, edit your Personal Information, or request a password reminder at any time. Our database stores your billing and delivery information, and will automatically transfer it to the order form each time you place an order so that you do not have to re-enter this information when you sign in at subsequent visits.
You can also create an "address book" whereby you enter information on our website about the names and addresses of people or entities you intend to send flowers or other products to. We do not use this information in any way other than to populate delivery addresses in online forms when you place an order in your direction.
3. Placing An Order
When you place an order, we require you to provide us with Personally Identifiable Information. This information allows us to process the orders that you place with us.
For your shopping convenience, when you place an order, we automatically establish your own Personal Account where information used in placing such order (including billing address, email address, telephone number(s), and rewards program information) is saved.
The recipient phone number, which you furnish to us when you place an order, is used for delivery purposes. On some occasions, the recipient may be called to schedule delivery. To maintain our high-quality standards, we will occasionally contact recipients to ensure satisfaction with their gifts.
4. Use of Information
In general, we will only use the information you provide to us for the purpose for which such information was provided. For example, we will use the information provided for processing orders and delivery of products. We may share such information with our third-party Service Providers as necessary to complete your order. For example, we will share your Personally Identifiable Information with our credit card processor to process credit card transactions for your order. We may also share your Personally Identifiable Information with the local florist who may be used to fulfill and deliver your order. Further, we may share your Personally Identifiable Information with FedEx or UPS to deliver your order.
We may also use this information to deliver to you information about our company and promotional material from some of our partners, trend analysis, pattern direction, and site administration. Your information may also be used to contact you when necessary and may be shared with other companies that may want to contact you with offers consistent with your stated preferences. Data collected through a short code program will not be shared with any third parties for their marketing reasons. Users may opt out of receiving future mailings from C’Blanc Rose and other entities by following the instructions set forth in the opt-out section below.
Non-personal demographic and profile data is used to tailor your experience at our site, showing you content we think you might be interested in. This information may also be shared with advertisers on an aggregate non-personal basis.
When you click through to our website from a promotional email, our Service Provider may send a cookie to your hard drive recording your IP address and other related information.
Some of our Service Providers may employ clear GIFs (also known as pixel tags, single-pixel GIFs, web beacons, or action tags) for our benefit to help us measure advertising effectiveness.
Clear GIFs help us better manage content on our website by informing us of what content is effective. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of our users.
The main difference between the two is that clear GIFs are invisible on the page and are much smaller, about the size of the period at the end of this sentence. Clear GIFs are not tied to your Personally Identifiable Information.
Our Service Providers may use clear GIFs: (i) in HTML-based emails to determine which emails have been opened by recipients; (ii) to record when products have been ordered from our site; and (iii) to track the visitor traffic on our site.
These clear GIFs allow us to measure the usage of our site by our visitors and the effectiveness of certain communications and marketing campaigns. We may also use clear GIFs in a similar manner in our own emails and on our site.
Clear GIFs can "work with" existing cookies on a computer if they are both from the same website or advertising company. That means, for example, that if a person visited "www.companyX.com", which uses an advertising company's clear GIF, the Web site would match the clear GIFs identifier and the advertising company's cookie ID number, to show the past online behavior of that computer.
This collected information can be shared with the advertising company. We may provide such information to our Service Providers but that information can only be used by our Service Providers for our benefit.
6. Credit Card Information
We collect credit card payments from users when they purchase our flowers or other products. No payments are collected without a user's explicit authorization. All credit card information is processed for us by a third-party merchant processing service, and we do not have access to any of our users' personal credit card information. Processing of the foregoing credit cards follows credit card industry standards.
As always, consumers making purchases must have a valid credit card and good credit standing.
7. Other Websites; Links
Our website may contain links to other websites. These websites may have different privacy policies and practices from C’ Blanc Rose. C’ Blanc Rose is not responsible for the privacy practices or the content of such websites. Accordingly, you access such linked sites at your own risk. We urge you to follow safe Internet practices and do not supply Personal Information to these websites unless you have verified their security and privacy policies.
8. Changes and Opting Out
If you would like to modify your account simply return to our website, and click on the link called "Your Account". Once you have signed in to your account a menu of options is provided for you to delete or edit your stored account information.
Unfortunately, to the extent that such information is also stored in other databases, we cannot always ensure that such corrections or deletions will reach the other databases. We will use all reasonable efforts to ensure that your information is removed from or corrected in our records.
You may opt-out of receiving communications from our partners, and from us, by sending an email to email@example.com.
9. Subpoena Policy
We will disclose Personally Identifiable Information, after subpoena or written request, to cooperate with a law enforcement investigation. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
We do not voluntarily disclose user personal information to unaffiliated third parties. If we are served with a subpoena for the personal information of a user, we will provide notice to the user whose personal information is sought by the subpoena to give them the opportunity to object to the subpoena. If the user does not object to the subpoena within a specified period of time, we will comply with the terms of the subpoena. Should the user object to the subpoena in a court of law, we will abide by whatever decision is reached by such a court of law.
10. Public Communication
We allow you to make public comments on our website in the form of product reviews and other comments. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.
We use the Secure Sockets Layer (SSL) technology. SSL encrypts your order information as additional protection against the decoding of that information by anyone other than us.
However, despite all reasonable security precautions and processes, such as password protection, encryption technology, and the use of firewall technology, no data transmission over the Internet can be guaranteed to be 100% secure.
As a result, while we strive to protect your Personally Identifiable Information, we cannot guarantee or warrant the security of any information you transmit to or from our website, and you do so at your own risk. Once we receive your transmission, we will take commercially reasonable precautions to protect its security on our systems.
If you open a Personal Account with C’ Blanc Rose, your password will be your personal, secret entry code to our website. When you access your account information, it is kept on a secure server and a password is needed to access any account areas.
You can change your password as many times as you like. We recommend that you keep your password in a safe place and that you always sign off your account and close your browser window once you have finished your visit.

12. Child Protection
We take special care to protect the safety and privacy of children. Our website may only be used by people aged thirteen (13) years old and over. Consumers making purchases on our site must have a valid credit card and be 18 years of age or older.
It is the policy of C Blanc Rose not to collect Personally Identifiable Information on any person under the age of 18 and we request that any person under the age of 18 not submit any Personally Identifiable Information via our website.
13. Sale, Trade, or Rental of Personally Identifiable Information
We only share Personally Identifiable Information with businesses that we believe to be reputable and that can provide you with offers and information that we think will be of interest to you.
We do share Personally Identifiable Information with our floral and gift distributors for the purpose of fulfilling and delivering your orders. We may offer free promotional emails and send promotional direct mail for products and/or services offered on our website or from businesses that we believe are reputable, as a service to our prior customers.
